Motor Vehicle Regulations

I. Policy Statement
- Texas Criminal and Motor Vehicle laws, in addition to university regulations, are in effect on St. Edward's University property 24-hours a day. Strict adherence
to all regulations is required to protect pedestrians and vehicles and to provide
access for emergency vehicles. The University Police Department has jurisdiction
to enforce the regulations with the right to remove or impound any vehicle operated
or parked in violation of the regulations. The owner of the vehicle will be required to pay the cost of moving and storing the vehicle. The chief of police has discretionary powers to enforce a traffic control policy on the campus that may not be covered by these regulations.
- Students, faculty and staff are expected to be familiar with and abide by these
regulations. The fact that a violation notice is not issued when a vehicle is
illegally parked does not mean or imply that the regulation or law is no longer
in effect. The responsibility for obtaining knowledge of all laws and
regulations in force rests with the motor vehicle operator.
- These regulations apply to all vehicles operated on the St. Edward's University campus. The term campus is interpreted to include all property in Austin, Texas, under the jurisdiction of St. Edward's University. The term vehicle
or motor vehicle is interpreted to include automobiles, trucks, motorcycles,
motorbikes, scooters and mopeds. Visitors are considered to be persons
other than students, staff and faculty who occasionally visit the campus for
pleasure, conferences or business.
- The University Police Department will exercise reasonable protection and security for vehicles on campus. At the same time, owners are expected to take the necessary steps to safeguard their property. The university assumes no responsibility for personal or property loss.

II. Registration Of Vehicles
- All vehicles operated or parked on the campus at any time by students, faculty
and staff must be registered and the permit properly displayed. Registration
in itself does not guarantee a parking space and does not ensure that parking
will be available near the place where one works, resides or attends class. The
responsibility of finding a legal parking space rests with the vehicle operator.
Lack of space is not a valid excuse for violating any parking regulations.
Faculty permits will be issued to faculty members holding appointments for the
current academic year. Staff permits will be issued to full-time and part-time
benefits eligible employees. Special Purpose permits will be issued to non-benefits
eligible personnel who are employed on the campus.
Resident permits will be issued to students living in residence halls or the apartment complex.
Commuter
permits will be issued to students residing off campus. The person in whose name
a vehicle is registered will be held responsible for any violation of these regulations.
It is a violation for a person to register a vehicle which belongs to another
person.
- The registration period for students extends for one year beginning Aug. 16. The registration period for all others extends for one year beginning July 1.
- As a general rule only one vehicle may be registered for any one individual.
Exceptions to this rule must be approved by the chief of police. When an exception
is granted, there is an expectation that only one of the registered vehicles
will be parked on campus at any given time.
Each vehicle must be registered separately and the applicable fee paid.
- Temporary parking permits may be issued at no cost. These must be displayed when using a temporary vehicle with temporary plates and other similar circumstances. Temporary permits allow users to park in their normally assigned areas.
- Faculty, staff, commuter students and students residing on campus will be issued
one exterior mounted parking permit. This exterior mounted permit
is self-adhering and MUST be affixed to outside driver's side rear window.
Convertibles may use outside passenger side windshield. Work trucks may use tool
box if window is blocked. Any other placement must be approved by the
University Police Department. Motorcycles
must have the permit permanently affixed and readily visible.
- Registered vehicles must be covered with minimal vehicle insurance required
by the state of Texas.

IV.
Operation of Motor Vehicles
- The maximum permissible speed on all campus streets is 20 mph, except in those
areas where the limits are designated otherwise. Speed in all parking
lots shall not exceed 15 mph.
- Pedestrians have the legal right-of-way in all crosswalks. A motor vehicle
operator observing any pedestrian in a crosswalk shall yield the right-of-way
to the pedestrian.
- A motor vehicle operator shall not back his/her vehicle into or through any
intersection.
- A motor vehicle should not be operated on any sidewalk, mall, plaza or lawn, except university-owned vehicles performing assigned maintenance functions.
- Motor vehicle operators should not operate their vehicles while anyone is sitting, holding onto or otherwise positioned on the exterior of the vehicle.
- Vehicle repairs and oil changes may not be done on the grounds, in parking lots or on university streets.

V. Parking of Vehicles
- Students, faculty and staff are restricted from parking in any space or area designated for visitors.
- The vehicle shall be parked so that the entire vehicle is within the limits
of the marked parking space.
- Drivers shall not park their vehicles in any place that will obstruct the
normal flow of traffic.
Any vehicle in violation of the following parking regulations is subject to removal at the owner's expense:
- On any sidewalk, mall, plaza or lawn.
- In any place designated as a loading zone.
- In front of or on any service drive or driveways.
- Beyond the outside ends of marked rows of spaces in parking areas.
- In front of movable barriers.
- In any place marked No Parking or Fire Zone.
- In any faculty or staff space unless displaying a faculty or staff permit.
- Parking at the curb on any street is prohibited unless signs or pavement markings
specifically indicate that parking is permitted.
- No trailer shall be parked on the streets or
anywhere
other than designated parking
areas.
- The parking of inoperable vehicles or vehicles purchased for
resale or trade, is prohibited.
- Motorcycles and scooters shall be parked in spaces marked for automobiles or in the motorcycle corral. Motorcycles shall not
be parked on sidewalks, malls or plazas. Mopeds may be parked in bicycle
racks but cannot be operated on sidewalks, malls or plazas.
- Spaces designated for disabled persons can be used only by vehicles displaying
an appropriate permit. These spaces are protected at all times. Vehicles illegally
parked in such spaces may be towed at the owner's expense at any time.
- Vehicles parked in fire lanes, obstructing traffic, or blocking loading zones
or dumpsters may be towed at the owner's expense.
- When loading or unloading heavy or bulky items, a note shall be placed on
the dash of the driver's side, signed by the driver, stating the situation (loading
or unloading) and time of day. A maximum of 15 minutes will be granted for parking
in these instances. However, the vehicle must be parked in a parking space or
loading zone and must be removed immediately upon completion of the loading/unloading
operation.
This policy does not include the right to park in a space designated for a disabled person.
- Students residing on campus may park only in areas designated for residential
parking or in lots allowing all permits.

VI.
Traffic and Parking Violation Procedures
Within 10 calendar days (school holidays excluded) of the receipt of a violation notice, the recipient must comply with one of the procedures listed below or a late fee will be assessed.

- Faculty and staff members may file an appeal to the University Police Office within 10 days. The chief of police will review all appeals and approve or disapprove the request. The decision of the chief of police is final. Students may appeal to the Student Traffic Court through the UPD within 10 days. The decision of the court is final.
- If a violation notice received by a student is not paid within 10 calendar days, charges will be forwarded to student financial services for posting to the student's account. A $5.00 late charge will be added. Students who fail to clear their accounts may be blocked from registration or, if graduating, may have their official transcript withheld.
- When, in the judgment of the chief of police, an individual fails to comply
with traffic and parking regulations to the point of becoming a disciplinary
problem, the University Police Department may refer the student to the dean
of students. Faculty and staff members may be referred to the head of the
program or office
in which they are employed, and parking privileges may be revoked.
- A vehicle tow list will be maintained by the University Police Department
for
repeat
violators (those with three or more outstanding violation notices).
Vehicles belonging to repeat offenders, even if parked legally at the time, may be towed, impounded and stripped of parking permits until all obligations are resolved and the vehicle is released by the University Police Department.
